Regular Session Senate Bill 124 – South Carolina Business Debt Recovery Act of 2011

Description
This bill would create a set of procedures for a creditor to recovery commercial debts through a rite of garnishment through income, wages, bonus and commission of the judgment debtor. It will also set the maximum garnishment not exceed 25 percent of the judgment debtor’s disposable earnings. It also add an clause that a creditor may not garnish the debtor if the debtor has been induced by the creditor in a consumer credit obligation to sign a statement that the debt is incurred for business or commercial purposes with the effect of making the debt subject to garnishment.
