Description
relating to punitive damages, the bill would provide limits on the award of punitive damages in all personal injury actions, and to provide for certain procedures and requirements related to the award of these damages. The bill also describes governing the retention of private attorneys by the attorney general or a solicitor; and to provide terms and conditions governing the retainer agreement, including limits on the compensation of outside counsel in contingency fee cases. The bill outlines that in cases of defective or unsafe improvements to property, violations of a building code do not constitute, per se, fraud, gross negligence, or recklessness. Additionally, regarding notices of appeal on the execution of judgment, the bill would provide limits for appeal bonds. Finally, regarding penalties for mandatory use of seatbelts, the bill seeks to delete language that violation of this article is not “negligence,” per se, or contributory negligence and is not admissible as evidence in a civil action
